REGULATION
Regulations should facilitate, not hinder, job creation and economic activity. We propose reforms in labour laws, healthcare, and education to remove barriers to opportunity and growth.
Right to Work
The good intentions of activists and legislators should not be allowed to stand in the way of the unemployed finding work.
- Insert an opt-out clause into the Basic Conditions of Employment Act that creates a job seekers exemption certificate for those who have been unemployed for an extended period of time. The certificate should enable unemployed persons to voluntarily exempt themselves from particular labour laws specified in the opt-out clause. The labour department could monitor for narrowly defined coercive tactics by employers.
- Amend the Labour Relations Act to ensure that bargaining council agreements cannot be extended to non-parties.
Healthcare
The right to determine one’s own healthcare affairs should be regarded as a non-negotiable aspect of human dignity.
- Repeal the National Health Insurance (NHI) Act and shelve NHI-related policies and structures.
- Medical schemes and health insurers should be enabled to offer low-cost products to ensure the indigent acquire access to high-quality private healthcare.
Education
The authority of governing bodies and the autonomy of independent educational institutions should be restored and respected.
- Repeal any measure that has limited the authority of parents in the management of public schools, especially the Basic Education Laws Amendment (BELA) Act.
- Revoke any government interference with homeschooling and independent schools outside of a strict construction of section 29(3) of the Constitution.
